What Rights Do I Have as a Tenant When There is a Bed Bug Infestation?

As a tenant, you always have the right to a home that is free of pests as much as possible. While the landlord is not going to be able to keep out all of the ants and flies all the time, you also shouldn’t have a big infestation to deal with like the rodents or with bed bugs. If there is a big pest infestation, then it is usually due to the fact that the landlord is not providing you with a home that is secure and safe from pests. And as the tenant, you are able to take some action to help with this.

 

Things are a bit different when it comes to bed bugs. In this case, it is usually not the fault of either party. There are some exceptions of tenants who will not take good care of the place and allow the bed bug infestation to get really bad, but this is an exception and not the norm for most people. Often, the bed bugs can come in on a new piece of furniture that you bought used or on your luggage when you traveled, and you didn’t realize that it was there until the infestation was bad.

 

In some situations, the landlord will be the one responsible for handling this infestation. But then they will see the problem and choose not to do anything about it. If you feel that the landlord is being slow to respond to the infestation or they instruct you to handle the infestation all on your own because they don’t want to deal with it, this is a sign that something is off. You should keep record of all the correspondence that relates to this so you have it for later.

 

When this happen, you can withhold the rent, decide that you do not want to be in the unit any longer and break the lease, or you can sue the landlord for not taking care of the problem.
